Welcome to WeddingWorkshops.com, provided to you by WeddingWorkshops, LLC (“WeddingWorkshops” or “Wedding Workshops”).  These Terms of Service govern your use of any WeddingWorkshops’s services.  Your use of WeddingWorkshops’s services constitutes acceptance of these Terms of Services and creates a binding legal agreement.   Please read the Terms of Service carefully.

All legal issues arising from or related to the use of this service shall be construed in accordance with the laws of the State of Massachusetts without regard to conflicts of law principles.   These Terms of Service constitute the entire agreement between you and WeddingWorkshops with respect to the use of this service.  WeddingWorkshops’s failure to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision or of any other rights or provisions in these Terms of Service.  If a court should find that one or more rights or provisions set forth in these Terms of Service are invalid, you agree that the remainder of the Terms of Service shall be enforceable and that the invalid provision shall be enforceable

Weddingworkshops.com maintains the WeddingWorkshops.com web site (the "Site") as a service to its customers and its customers end consumers (collectively defined as the "Users"). Please review the following terms and conditions carefully. This Terms of Use Agreement (the "Terms of Use") is a legally binding contract between each User and WeddingWorkshops.com regarding Users' access to and use of the Site. By accessing the Site and/or any of our affiliate member web sites (each, an "Affiliate Member"), the User agrees to the terms and conditions as outlined in this legal notice. WeddingWorkshops reserves the right to change these terms and conditions from time to time at its sole discretion by posting such revised terms and conditions on the Site. User's continued use of the Site and the Service provided to you by the Site and/or any Affiliate Member site following any such change constitutes an agreement to follow and be bound by the terms and conditions as changed. If a User does not agree with any part of the following terms and conditions, she/he must not use this Site and/or any Affiliate Member site.

General
WeddingWorkshops.com provide you with access to the WeddingWorkshops.com Web site and the services available on this Web site, or any other Web sites that weddingworkshops services are available on as indicated under the “Services” Section listed below, (collectively, the "Services," which will be defined more under the Section, "Services."). Access to and use of the Services is governed by these Terms of Use (the "Agreement"). By accessing or using the Services, you indicate your assent to be bound by the Agreement, and your acknowledgment of and agreement to its terms.

Services
The Services include WeddingSite™ (located at www.WeddingWorkshops.com) The Services may also be located on third party web sites and/or applications either as a link from an add-on service to, or otherwise in connection with, Web sites and/or applications that such third parties control.  Our WeddingSite service is a personal wedding website creation software tool that is designed to enable soon to be wed clients the ability to create their very own personal wedding web site with no web design experience needed.  
The technology underlying, and content within, the Services is owned by WeddingWorkshops.com and is protected by copyright and other intellectual property or proprietary rights. If you use the Services other than as provided above, you may violate copyright and other laws of the United States, other countries, as well as applicable state laws and may be subject to penalties. That would not be a good thing. As between you and WeddingWorkshops.com, WeddingWorkshops.com owns and retains all ownership of the technology underlying and content within the Services, and reserves all rights not explicitly granted to you in this Agreement.

Registration
You agree that the information that you provide to us on registration and at all other times will be true, accurate, current and complete.  You also agree that you will ensure that this information is kept accurate and up to date at all times.   This is especially important with respect to your email address, since that is the primary way in which we will communicate with you about your account and your orders.   We will use the information you provide to us in accordance with our Privacy Policy.

Length Of Service
WeddingWorkshops service subscriptions expire 90 days after the registered date of your wedding.

Termination
WeddingWorkshops.com may terminate access by Users to the Site and/or the provision of any of the services offered by WeddingWorkshops.com at any time for any reason, including any improper use of this Site or Users' failure to comply with this Terms of Use. Such termination shall not affect any right to relief which WeddingWorkshops.com may be entitled to, at law or in equity. Upon termination of this Terms of Use, all rights granted to Users will terminate and revert to WeddingWorkshops.com.

Service Level Agreement
WeddingWorkshops will provide a 99% availability of its WeddingSite services, and the web site’s that it powers.   Occasional service outages may occur that WeddingWorkshops cannot control.   If such outages occur, WeddingWorkshops will work on restoring service as soon as possible.   WeddingWorkshops is not liable or responsible for damages if such outages occur.

WeddingWorkshops will provide all customer service and support.   We are not yet set up for telephone support and are best contacted via email at support@weddingworkshops.com.   We will respond to all customer service inquiries, usually, within twenty-four hours of receipt, Monday through Friday, 8:00AM to 5:00PM EST.

Domain Name Usage and Ownership
During the length of service, WeddingWorkshops is the legal owner/registrant of the domain name you publish your web site to.   We assign the domain name to you for the exclusive use of your web site.   This domain name cannot be transferred by you during your subscription.

Web Site Content
WeddingWorkshops does not control the content of any user’s account and does not have any obligation to monitor such content for any purpose.   All content provided by a user of any WeddingWorkshops services is the sole responsibility of that user.  WeddingWorkshops will not power any web site that contains pornographic, offensive, or unlawful material.  Upon discovery of such material, WeddingWorkshops reserves the right to remove the material and terminate your subscription.  Copying any content on any WeddingWorkshops.com site or site created by or with use of WeddingWorkshops.com services is strictly prohibited. 
Control over Features, Functions, and Access to the Services

WeddingWorkshops.com reserves the right to change any information, features and functions of the Services without prior notice. WeddingWorkshops.com may deny you access to all or part of the Services without prior notice if you engage in any conduct or activities that WeddingWorkshops.com determines, in its sole discretion, violate this Agreement, the rights of WeddingWorkshops.com or any third party, or is otherwise inappropriate. 
Assignment
Users may not assign, convey, subcontract or delegate their rights, duties or obligations hereunder.

Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. WEDDINGWORKSHOPS.COM DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 
WeddingWorkshops.com Potential Liability for the Services is Limited

THE SITE, AND THE CONTENTS THEREIN AND/OR THE CONTENT PROVIDED BY WEDDINGWORKSHOPS.COM TO AN AFFILIATE MEMBER SITE, ARE PROVIDED "AS IS" AND "AS AVAILABLE", AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, QUIET ENJOYMENT, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. REPRESENTATIONS AND WARRANTIES. 
You represent, warrant and covenant that you have sufficient authority to enter into the Agreement and that your use of WeddingWorkshops.com services is solely for lawful commercial and business purposes.

Choice of Law, Waiver, and Claims
This Agreement shall be governed by the laws of the State of Massachusetts without regard to its conflict of law provisions. WeddingWorkshops.com failure to exercise or enforce any right or provision of the Agreement will not be deemed to be a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Arbitration	
Any controversy or claim arising out of or relating to this Agreement or the Services will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim must be arbitrated on an individual basis, and must not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration must be conducted in Springfield, Massachusetts, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or WeddingWorkshops.com may seek any interim or preliminary relief from a court of competent jurisdiction in Springfield, Massachusetts, as necessary to protect the rights or property of you or WeddingWorkshops.com. 
Additional Terms

Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this Site, and Users agree to abide by such other terms and conditions.

Entire Agreement
This Term of Use constitutes the entire agreement between each User and WeddingWorkshops.com. Additionally, this Terms of Use shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions. The heading used in this Terms of Use are included for convenience only. Users acknowledge that they have read this Terms of Use, understand it, and agree to be bound by its terms and conditions. Users further agree that it is the complete and exclusive statement of the agreement between Users and WeddingWorkshops.com which supersedes any proposed or prior agreement, oral or written, and any other communications between Users and WeddingWorkshops.com relating to their use of the Site.

U.S. Export Controls.
Software from this Site is further subject to United States export controls. No software from this site may be downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other Country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.

Copyrights

WeddingWorkshops respects the intellectual property rights of others.   If you believe your copyright in a work has been violated through this service, please contact WeddingWorkshops for notice of claims of copyright infringement.  You can reach us at: support@weddingworkshops.com, or at WeddingWorkshops, LLC, P.O. Box 35, Feeding Hills, MA 01030.  We are not yet set up for telephone support.   You must provide the following information, which WeddingWorkshops may then forward to the alleged infringer:
1.  	Describe the copyrighted work that you believe has been infringed;
2.  	Identify the material on the web site that WeddingWorkshops powers that you believe infringes your work, with enough detail so that we may locate it;
3.  	Provide your contact information, including: full name, address, telephone number, and email address;
4.  	Provide a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
5.  	Declare under penalty of perjury that
 (a) 	the information you have provided to us is accurate, and
 (b) 	you are the owner of the copyright interest involved or you are authorized to act on behalf of that owner; and,
6.  	Provide your physical or electronic signature.

Upon receiving your complaint, WeddingWorkshops may remove content that you believe infringes your copyright.   In addition, WeddingWorkshops may terminate the account of the member who appears to be infringing your intellectual property rights.

WeddingWorkshops claims no ownership rights in any image contained in any of the web sites it powers.  Please note, however, that when you share your web site, you allow your web site guests to share and make photographic prints from the images contained on your web site.   For the sole purpose of displaying your images through your WeddingWorkshops web site, you grant to WeddingWorkshops a non-exclusive, royalty-free license to use, copy, distribute, and display those images.

Copyright
WeddingWorkshops respects the intellectual property rights of others.   WeddingWorkshops claims no ownership rights in any image contained on your web site and will not share your images unless instructed by you or otherwise required by law.   Please note that when you upload images and allow your web site guests to view them, you allow your guests to share and make photographic prints from the images contained on your web site.

Your Conduct
You are responsible for all of the images you upload, share or copy using WeddingWorkshops’s service.  You must have the legal right to display each image that you upload or share.  Professional images that are provided to you by professional photographers or made available through web sites magazines, books or other resources, are protected by copyright and should not be uploaded, shared or copied using this service.

In addition, the actions further described below, will constitute grounds for blocking your access to our service, removal of posted material and non-fulfillment of your order (or any part of your order).  As condition of your use of this service, you shall not: upload, post, order for print, email or otherwise transmit any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, vulgar, invasive of another's privacy, hateful, or otherwise objectionable; upload, post, order for print, email or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) or any content that infringes any trademark, trade secret, copyright or other proprietary rights of any party; harm minors in any way, including, but not limited to, content that violates federal and state child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct; forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through this site.

WeddingWorkshops reserves the right to refuse to fulfill any order, or any part of any order, if it believes that these Terms of Service have been violated.   In addition, WeddingWorkshops reserves the right to disclose any account or order information when it believes in good faith that the law or legal process requires it, or when it is necessary to do so to protect the rights or property of WeddingWorkshops or others.

Trademark and Copyright
WeddingWorkshops and all graphics, logos and service names used to identify WeddingWorkshops’s products and services are trademarks of WeddingWorkshops, LLC.   Third party trademarks used in connection with this service are the property of their respective owners. You are not entitled to use any trademark in connection with any product or service without the express permission of the owner of that trademark.

You should assume that all of the content or other works made available to you through the service (together, the "Content") is protected by copyright or other proprietary rights.   You are not entitled to duplicate, create derivative works of, distribute, display or perform any Content without the express permission of the owner of that Content.

You understand and agree that the submission of digital image to WeddingWorkshops, and the download of any material through WeddingWorkshops’s service is done at your own discretion and risk and that you will be solely responsible for any loss or damage to your image, any loss of your image and any damage to your computer system or loss of data that may result in the download of any material.  You are solely responsible for creating back-ups of your digital images.

Except as expressly provided in the preceding paragraph, to the fullest extent allowed by law, WeddingWorkshops shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, and punitive damages resulting from the use or provision of WeddingWorkshops’s service or site, even if WeddingWorkshops has been advised of the possibility of such damages.  The foregoing disclaimers, waivers and limitations shall apply notwithstanding any failure of essential purpose of any limited remedy.

The Personal Information We Collect
WeddingWorkshops collects personal information necessary to respond to your requests for our customized products and services and to allow you to use the resources available on our website, including the creation and maintenance of a Wedding Account and a Wedding Website.   Personal information includes, but is not limited to, name, physical address, email address, phone number, age and any other information that itself identifies or, when tied to the above information, may identify you as a specific individual.  WeddingWorkshops also collects information related to your wedding, including dates and places of the rehearsal, wedding and reception, and information relating to your gift registry.

"Cookies" are small pieces of information that are stored by your browser on your computer’s hard drive.  We use cookies in several ways (and thousands of other sites are currently using them too!).  Cookie files are used to better understand how you go through our website so that we may tailor your experience at our website.   Cookies are also used to tell us whether you have visited our website previously, and to help us determine how you got to our site.. IP Addresses

When you provide information to WeddingWorkshops, the information is stored in our databases and such information is used in accordance with this Privacy Policy. Any information regarding your wedding and event guests will not be shared with any third parties and will not be used for any promotional purposes.

In addition to the circumstances described above, we may disclose your information if required to do so by law, court order, as requested by other government or law enforcement authorities, or in the good faith belief that disclosure is otherwise necessary or advisable, including (without limitation) when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

The Choices You Have About The Collection and Use Of Your Information
As a user or customer you will occasionally receive e-mail updates from us about important functionality changes, special offers from us, new services and other noteworthy news items about us.  We hope you will find these updates interesting and informative.   Of course, if you would rather not receive them, just let us know by adding your email address to our remove list.   In other words, if you don't want us to send you promotional e-mails, just let us know.   WeddingWorkshops reserves the right to limit registration to those who will accept emails and to those who will provide the requested information.

Your Ability To Access, Update or Correct Your Information
At any time, you can view and/or update all of the information contained in your account or wedding website by logging in to your account and following the appropriate links.   However, even if you delete or change some personal information in our registration database, it may still be stored on our databases (including those kept for archival purposes).

Third Party Service Providers
We may share your personally identifiable information with those companies that assist us in providing The Wedding Site service to you.

Additional Information About Online Privacy and Changes To Our Policy
Please be aware that on our site we may have advertisements and links to other websites that may collect personal information about you.  This Privacy Policy does not cover the information practices or policies of such websites.   We encourage you to read the privacy policies of all such sites, as their policies may be materially different from our Privacy Policy.   Any material changes in the way we use personal information will be described in future versions of this Privacy Policy.  Of course, you may always submit concerns regarding our Privacy Policy or our privacy practices to our Customer Service Center at support@weddingworkshops.com.
